James Leahy

James Leahy is a Miami IP Attorney practicing at the intersection of intellectual property, technology, artificial intelligence and consumer protection law.

A seasoned litigator, James has advanced over fifty Federal, State, arbitration and administrative claims in Florida, Texas, California, New York, Arizona and before the USPTO Trademark Trial and Appeal Board (TTAB) involving complex intellectual property with a focus on emerging technologies such as blockchain, AI, e-commerce, software, and health & lifestyle products. His practice includes the gambit of start-to-finish intellectual property enforcement and defense, including: conducting pre-filing investigations, analysis of patent and trademark infringement claims, bringing technology-related lawsuits and counterclaims, preparing comprehensive post-filing discovery, advancing written discovery, analysis of electronic discovery (including via Relativity, CS DISCO and Logikcull), fact and expert deposition strategy and arguing in-chambers hearings. Mr. Leahy has particular acumen in architecting dispositive strategies including Daubert challenges, Markman construction, summary judgment briefings, and motions in limine.

His litigation experience further includes software infringement under 18 U.S.C. § 1836, domain name cybersquatting under 15 U.S.C. § 1125(d), trade dress infringement disputes under the Lanham Act, dilution claims under 5 U.S.C. § 1125(c), defending Schedule A claims, defending website accessibility claims under Title III of the Americans with Disabilities Act, misappropriation claims under Florida's Right of Publicity Statute (Florida Statute § 540.08), investigating deepfakes under Brook's Law (Florida Statute § 836.13), defending suits under Florida's Security of Communications Act (Florida Statute § 934.01), bringing claims under Florida's False Advertising Statute (Florida Statute § 817.41), cyberstalking take downs under Florida Statute § 784.048, as well as protecting victims under Florida's Sexual Cyberharrassment Law (Florida Statute § 784.049).

Outside the courtroom, Mr. Leahy has considerable experience in technology transfer agreements, including international licensing, purchase and sale agreements (PSAs) and related IP due diligence. As a former college football player at the University of Chicago, he also assisted athletes with name, image and likeness (NIL) matters.

Prior to practicing, James was an Articles Editor for the Bill of Rights Journal at William & Mary Law School, and a Research Fellow for the Center for Legal & Court Technology, with research focusing on the intersection of Artificial Intelligence and intellectual property law, along with data privacy and compliance under the European Union's General Data Protection Regulation.
